1. ABOUT DEALIA

Dealia.com.au is an online Australian marketplace platform that allows:

  • Businesses to create profiles, list deals, products, and services, and use Dealia to sell, advertise, or accept bookings.
  • Customers to browse listings, compare deals, and make purchases, orders, or bookings directly through the website.

Dealia acts solely as a platform facilitator. We are not the seller, manufacturer, or provider of any product or service listed by third-party businesses on our platform unless otherwise stated.

2. ELIGIBILITY

2.1 For Businesses

To register a business account, you must:

  • Be located in Australia
  • Provide accurate contact and business details
  • Hold a valid ABN (Australian Business Number)
  • Be legally authorised to represent the business

2.2 For Customers

You must:

  • Be at least 18 years of age
  • Provide accurate personal information
  • Use the platform for lawful purposes only

3. BUSINESS ACCOUNTS & LISTINGS

Businesses using Dealia agree to:

  1. Provide accurate, up-to-date business details
  2. Ensure all products, services, deals, and promotions comply with Australian Consumer Law
  3. Honour all bookings, orders, purchases, and promotions listed on Dealia
  4. Comply with product safety regulations, advertising standards, and pricing accuracy
  5. Not mislead customers in any way
  6. Maintain responsibility for fulfilment, delivery, customer service, refunds, and warranties

Dealia reserves the right to edit, hide, or remove listings that:

  • Are misleading
  • Contain prohibited items
  • Violate Australian law
  • Do not meet our content or quality standards

4. CUSTOMER ACCOUNTS

Customers agree to:

  • Provide accurate information
  • Not misuse the platform
  • Only make legitimate orders or bookings
  • Not attempt to harm, disrupt, or exploit the system

You are responsible for maintaining the confidentiality of your account.

5. PAYMENTS

Dealia may process payments on behalf of businesses using third-party secure payment providers.

By completing a purchase or booking, you acknowledge that:

  • Payments may be taken on behalf of the business
  • Dealia is not responsible for the quality, delivery, or fulfilment of goods or services
  • Businesses remain the official “merchant of record” unless otherwise stated

6. FEES AND COMMISSIONS

  • Businesses may be charged subscription fees, listing fees, service fees, or commissions depending on their chosen plan.
  • All applicable fees will be disclosed at signup and in the business dashboard.
  • Fees are non-refundable unless required by law.

7. CANCELLATIONS, REFUNDS & DISPUTES

  • 7.1 For Customers

    All refund, cancellation, and dispute policies are determined by the business providing the product or service, in accordance with Australian Consumer Law.

    Customers must contact the business directly for:

    • Order issues
    • Refund requests
    • Booking changes or cancellations
    • Warranty claims

    7.2 Platform Involvement

    Dealia may assist with disputes at our discretion but is not obligated to resolve them and is not responsible for any outcomes.

8. PLATFORM ROLE & LIMITATION OF LIABILITY

  • Dealia is a platform facilitator only.
    We do not:

    • Own or control the businesses listed
    • Guarantee product quality or availability
    • Provide warranties for third-party goods/services
    • Take responsibility for delivery issues, booking failures, or disputes

    To the maximum extent permitted by law, Dealia is not liable for:

    • Losses caused by third-party businesses
    • Errors in listings or pricing
    • Service interruptions
    • Customer or business misconduct
    • Data loss or unauthorised access beyond our reasonable control

    Nothing in these Terms limits your rights under Australian Consumer Law.

9. USER CONTENT

  • Users and businesses may upload content such as:

    • Business descriptions
    • Images
    • Deals
    • Reviews

    You grant Dealia a non-exclusive, royalty-free license to display this content on the platform.

    You must not post:

    • Inaccurate, false, or misleading information
    • Offensive or inappropriate content
    • Material infringing on copyright or trademarks

9. USER CONTENT

  • Users and businesses may upload content such as:

    • Business descriptions
    • Images
    • Deals
    • Reviews

10. PROHIBITED USES

  • You must not use the platform to:

    • Harm the platform’s functionality
    • Misrepresent your identity
    • Violate Australian laws

11. PRIVACY

Your use of the platform is also governed by our Privacy Policy, which explains:

12. INTELLECTUAL PROPERTY

All content created by Dealia — including logos, design, layout, text, and code — remains the property of Dealia and may not be reproduced without permission.

13. TERMINATION

  • Engage in fraudulent or harmful activity
  • Fail to pay required fees

Users may close their account at any time.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. Continued use of the platform constitutes acceptance of updated terms.

These Terms are governed by the laws of Australia and the state or territory in which the business is registered.
